Terms and Conditions

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the expense tracking application (the "Service") operated by Costierge Technology ("us", "we", "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

1. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. Data Usage and Privacy

Our Service allows you to record and track your expenses. You retain full ownership of your data.

We collect and store your expense data solely to provide and improve the Service. We do not:

• Sell your data to third parties
• Use your data for marketing purposes without your explicit consent
• Share your expense information with other users or companies
• Train our AI models using your personal expense data or receipt images
• Use your data for any purpose other than providing and improving our core Service features

By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy.

We implement reasonable security measures to protect your data, but we cannot guarantee its absolute security.

3. Subscription and Pricing

3.1 Subscription Changes

We reserve the right to modify our subscription plans, including but not limited to:

• Changing the price of subscriptions
• Modifying the features included in subscription tiers
• Adding or removing subscription tiers
• Adjusting billing cycles
• Modifying usage limits

We will provide notice of any pricing changes at least 30 days before they take effect. If you continue to use the Service after the price change takes effect, you agree to pay the modified price.

3.2 Billing

Subscription fees are billed in advance on a recurring basis. You authorize us to charge your chosen payment method for these recurring payments.

3.3 Refunds

Subscription fees are non-refundable except where required by law. Partial refunds or credits may be given at our discretion.

4. Service Modifications

We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period.

5. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

6. Limitation of Liability

In no event shall Costierge Technology, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use or alteration of your transmissions or content

7. AI and OCR Technology Disclaimer

The Service includes artificial intelligence (AI) and Optical Character Recognition (OCR) features for scanning and processing receipts and other expense documents. By using these features, you acknowledge and agree to the following:

• The accuracy of AI and OCR technology is not guaranteed and may vary depending on various factors including but not limited to image quality, lighting conditions, document format, and text clarity
• You are responsible for reviewing and verifying all AI-processed data for accuracy
• We are not liable for any errors, omissions, or inaccuracies in the data extracted through our AI and OCR features
• You should maintain original copies of all receipts and documents for your records
• The AI features are provided as convenience tools and should not be solely relied upon for legal, tax, or accounting purposes

8. General Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
